When a person is injured in a serious automobile accident caused by a negligent driver and later dies as a result of the injuries sustained, the victim's demise is considered a wrongful death. Even though the death did not occur during the crash, it was a direct result of the other drivers' negligence.
A 48-year-old man was left fighting for his life after he was struck by a car in Ocala, Florida. The man was riding his bicycle on South Pine Avenue when the accident occurred at approximately 5 p.m. Monday evening, Feb. 20, 2012.
According to the Ocala Police Department, the bicyclist had attempted to cross the roadway when he was struck by an oncoming Nissan Maxima. The Maxima was being driven by a 20-year-old man who claimed that the cyclist had come out of nowhere.
The man was immediately transported by helicopter to Shands at the University of Florida in Gainesville. There, he was attended to by doctors who said that injuries were life-threatening. Whether the cyclist will survive those injuries is not yet known.
A representative for the Ocala Police Department reported that while the Bicyclist struck by car and injured investigation remains ongoing it is unclear if the driver of the car will be charged in the incident.
Although no amount of money will bring back a life that was lost, families who lose a loved one due to the negligence of another may seek compensation for their loss. At times a suit can bring closure to a situation, force a negligent party to face responsibility or simply provide for the financial losses suffered by the family.
